Terms of Sale
These Terms of Sale apply to purchases from McClendon Bakery & Co through this website. By submitting an order, you agree to these terms and to the product, price, fulfillment, cancellation, and other details shown at checkout. If an order confirmation contains different order-specific terms, the confirmation controls for that order.
Nothing in these terms limits rights that cannot be waived under applicable law.
Cottage-food products
McClendon Bakery & Co offers foods made and sold under applicable Texas cottage food laws and regulations that apply to its operation. Products are intended for the end customer and may not be resold unless McClendon Bakery & Co expressly agrees and the resale is lawful.
Please read the product label and any required cottage-food disclosure provided with your order. Product descriptions and photographs are provided to help you choose, but handmade items may have reasonable variations in color, decoration, size, or appearance.
Ingredients and allergens
Ingredient and major-allergen information is provided with each product listing and on the product label as required by applicable law. Products are prepared and packaged in a home kitchen where allergens are present. No product is represented as allergen-free, and cross-contact cannot be ruled out.
If you have an allergy, intolerance, or dietary requirement, please review the available information and contact McClendon Bakery & Co. before ordering. You are responsible for determining whether a product is suitable for you or the intended recipient.
Orders and availability
An order is not accepted until McClendon Bakery & Co. confirms it or payment is successfully completed, as indicated during checkout. Products, pickup dates, and quantities are subject to availability. McClendon Bakery & Co. may decline or cancel an order due to an error, unavailable ingredients, limited capacity, suspected fraud, or an unsafe or unlawful request. If McClendon Bakery & Co. cancels a paid order, the amount charged for the canceled portion will be refunded.
You are responsible for providing accurate contact and order information and for reviewing your order before submission.
Prices and payment
Prices are shown on the website and may change before an order is placed. The total shown at checkout includes your selected products and any applicable taxes, discounts, or fees.
Payments are processed securely through the payment provider shown at checkout. By completing checkout, you authorize the payment provider to charge the displayed amount to your selected payment method.
Custom orders, changes, and cancellations
Special orders require at least one week’s notice and are subject to availability. Any special requests or details must be agreed upon before the order is confirmed.
If you need to change or cancel an order, please contact McClendon Bakery & Co. as soon as possible. We will do our best to accommodate changes when we can. Because each order is made fresh and requires advance preparation, changes, cancellations, or refunds may not always be possible once preparation has begun.
If your order is incorrect or damaged, please contact us promptly so we can work with you to make it right.
Pickup
All orders are available for local pickup in Abilene, Texas. Available pickup dates and times are shown during checkout. Orders must be placed at least 48 hours before the selected pickup time.
Please plan to pick up your order during your selected pickup window. If you’re running late or need to adjust your pickup time, please contact McClendon Bakery & Co. as soon as possible. We will do our best to accommodate changes when we can.
Once an order has been picked up, the customer is responsible for appropriate storage and handling.
Tips are optional and intended for our delivery drivers. If you're picking up your order, please select "No tip."
Delivery
Delivery is available on select dates and times shown at checkout, within our 8 mile delivery area. Delivery orders require a $40 minimum subtotal, before the $5 delivery fee. Please provide an accurate address and any access or drop-off instructions. Optional tips are available for our delivery drivers.
Once an order has been delivered to the address and drop-off location you provided, you are responsible for bringing it inside promptly and storing it appropriately.
Responsibility and resolving concerns
Once an order has been picked up or delivered, the customer is responsible for appropriate storage and handling.
If there is a problem with your order, please contact McClendon Bakery & Co. as soon as possible so we have an opportunity to make it right. We’ll do our best to resolve concerns fairly and reasonably.
Customer accounts and communications
If you create an account, you are responsible for keeping your account information secure.
By placing an order, you agree to receive order-related communications using the contact information you provide. Any optional marketing emails or text messages may be unsubscribed from at any time.
Changes and contact
McClendon Bakery & Co. may update these terms from time to time. The terms in place when an order is submitted will apply to that order.
